Please find below a
transcript of the last will and testament of Judith
Sellers. This will was recorded in Hall County Georgia. It was
provided to me by Carl Sellars. The Young Sellers referred
to is Young
Sellers of Jackson County Alabama and the David Sellers is of St.
Clair
County Alabama. She list her age as 100 years on the 1850
Hall County
Census and birthplace as
North Carolina and is a widow.

In the name of God, Amen.
I Judith Sellers of said
county and State being of advanced age and
knowing that it is ordained
that we must all die, I therefore deem it
right and proper both as to
respects myself and children that I should
make a disposition of the
property and other effects with which a kind
providence has blessed me.
I therefore make and ordain
this my last will and testament hereby
revoking and annulling all
others heretofore made by me.
Item first - I desire that
my body be buried in a decent and Christian
like manner suitable to my
circumstances and conditions. My soul I
trust will return to rest
with God who gave it as I hope for eternal
Salvation through the
blessed Lord and Savior Jesus Christ.
Item 2nd - I desire and
direct that all my just debts be paid without
delay -
Item 3rd - I give and
bequeath to my son, Young Sellers, one dollar only
to him & his heirs it
being in addition to the five hundred Dollars
given some years ago &
for which I hold his receipt.
Item 4th - I give and
bequeath to my son in law, William D. Reed (alias)
William D. Cockram the sum of one dollar only
to him and his heirs in
addition to the sum of five
hundred dollars already given him and for
which I hold his receipt and
my will is that William D. and Young
Sellers nor any of their
heirs have anything more from my estate.
Item 5th - I give and
bequeath to my daughter Catherine Green of South
Carolina and her children
the one seventh part of all my estate to them
and their own separate and
sole use and benefit and in the event that
said Catherine Green should
depart this life before I do then the said
one seventh part of my
estate I give and bequeath to her children
jointly.
Item 6th - I give and bequeath to my grand
daughter Mary Floyd the sum
of one hundred dollars in
addition to what she has already
received.
Item 7th - I give and
bequeath to the children of Mary Biford, Happy
Hanes, Cynthia Flynn and
David Sellers,
viz to each set of children the
one seventh part of my
estate deducting from the part going to the
children of Happy Hanes the
sum of three hundred dollars above already
paid & for I have a
receipt, viz to Judith Hanes one hundred dollars to
Andrew Hanes one hundred
dollars to Catherine Hanes one hundred dollars.
Item 8th - I give and
bequeath to my son James Sellers or in the event
of his death & having
legal heirs the one seventh part of my estate.
Item 9th - I give and
bequeath to my son Hiram Sellers or in the even of
his death and having legal
heirs the one seventh part of my estate and
in the event that there be
no legal heirs of the aforesaid Hiram and
James Sellers and they or
either of them be dead and or person clothed
with legal authority comes
forward to claim their interest within four
years after my decease my
will in that event is that such portion of my
estate not claimed for them
or their heirs be equally distributed
amongst my other children
and grand children in terms of law providing
for such division.
Item 10 - My desire and will
is that my executors hereinafter named
shall proceed to dispose of
all my property at public sale and proceed
to collect the money for the
same together with all other debts due my
estate with least delay and
proceed to distribute thereof in terms of
this my will.
Item 11 - My will is that no
interest shall be required by any of the
legatees from my executor
until after a legal demand is made for their
distributive share of said
estate.
Item 12 - I hereby
constitute and appoint Minor W. Brown and James Law
my executors to this my last
will and testament this 14th day of October
1847.

Whereas I did on the
fourteen day of October eighteen hundred forty
seven signed sealed declared
and published my last will and testament in
presence of Richard Wilson,
Michael Whitmire and B. Whitmire which I
appointed Minor W. Brown and
James Law my executors and whereas the said
James Law has since the time
of his appointment departed this life I now
therefore appoint and
constitute Ralph S. Law my executor in place of
the said James deceased
hereby ratifying and confirming all the
provisions of my said will
witness my hand and seal the 5th day of May
1851.
