Notes for MARY BERTHENA SELLERS:
The Miller Rolls was compiled as a result of three court cases brought by
the Cherokees against the United States Government. These suits concerned
grievances arising out of the 1835 Treaty - - the removal treaty that had
relinquished Cherokee lands in the east. In 1905, the U.S. Court of Claims
ruled in favor of the Cherokees, and the following year Congress
appropriated one million dollars to settle the claim. The task of
identifying those persons eligible to receive a share of these funds was
assigned to Guion Miller, special commissioner of the Court of Claims.
The court decree stated that the individuals alive on May 28, 1906, who
could establish the fact at the time of the 1835 treaty, they were members
of the eastern Cherokee tribe or were descendants of such persons, were
entitled to share in the distribution of funds. Applications for minors were
to be filed by the parents or guardians; applications for individuals who
had died after May 28, 1906, were to be filed by their children or legal
representatives.
More than 45,000 applications, representing more than 90,000 individual
claimants, were filed between 1906 and 1908. A total of 30,820 persons were
found to be eligible for a share of the funds and are listed on the Miller
Roll. Her application claim #18570 and the testimony of her son Isaac M.
Minton #4570 can be found in the 1909 Guion Miller Rolls on file at the
National Archives, Record Group 75, Microfilm Publication M1104, Roll # 166.
On her application she claimed her mother Jane (Gibson) Sellers was 1/4
Cherokee blood and her grand mother Jemima Brown was 1/2 Cherokee blood. Her
application was rejected because none of her ancestors appeared on any
earlier Cherokee rolls. Mary B. was referred to as "Granny
Minton".
She was living with her son Julius "Jule" C. Minton at the time
of her death
in Crudup, Alabama.

His name appears as William
Riley Minton in the 1850 Gilmer County, Georgia census. On Mary B. Minton's
application in 1907 to The US Court of Claims she listed her husband as
Riley Minton. By all accounts his name was William W. Minton.
"Riley" may
have been one of his nicknames along with "Pap" by which he was
known during
his service in the Civil War.

further list as grandparents on her mother's side as Joe Gibson and Jemima
Brown, born in NC. This Document was signed as witnessed by Fannie Scroggins
(daughter) and Forney Hughes.

It's been awhile since I have posted this so I hope somebody
can help me. I am looking for William Minton born bet.
1815-1825. His nickname was probably Pap or Riley. His name
appears as Wm. W. Minton on his marriage license to Bertha
Sellers on January 28, 1858 in Gilmer County, Georgia.
In the 1850 Gilmer County, Georgia census his name appears
as William Riley Minton.
In the 1880 Mountain, Gilmer County, Georgia census his age
is 63, this gives him a date of birth abt. 1817. (FHL Film
#1254148; National Archives Film T9-0148, page 546D)
On Mary B. Minton's application in 1907 to The US Court of

I descend from Mary Berthenia Sellers. She is the sister to John S.
Sellers (March 1822). They are the children of Isaac Marion Sellers &
Jane Gibson. Jane Gibson is the daughter of John Gibson & Jemima
Brown. I have John S. Sellers married to a Mary Carolina Hemphill.
Their daughter Mary Jane Sellers (b. 1844 NC - d. 1896 AL) married to David
Crockett Sisson. I have Mary Berthenia Sellers application filed with The
United States Court of Claims listed in "The Giuon Miller
Rolls". In this application Mary Berthenia Sellers claims that her
Mother Jane Gibson is 1/4 Indian blood & Jane's Mother Jemima Brown has
having 1/2 Indian blood. I would like to talk with you further.

However I don't see Isaac SELLERS 1800 (mary berthenia sellers minton's dad)
on an 1830/40 census with dau this age = may NOT have correct census?
1840 Where is this family?
She is on the 1850 GA census. (mary 1835) with her brother isaac 1841.
And Margaret 1829/30 should be on an 1850 NC census. Jackson Co, NC?
